I. Warranty Statement

P & W Service Center warrants the pagers and equipment listed on the invoice for the period of time specified below from the ship date listed on the Invoice. This express warranty is extended to the original purchaser and is not assignable or transferable to any other party. ALL ORIGINAL MANUFACTURES WARRANTIES SUPERSEDE THIS WARRANTY AND PRODUCTS MUST BE SENT DIRECTLY TO THE MANUFACTURE FOR ALL WARRANTY REPAIRS.

II. General Provisions

This warranty sets forth the full extent of P & W Service Center's responsibilities regarding the pagers and equipment covered by this warranty. Repair, replacement, or refund of the purchase price, at P&W Service Center's option, is the exclusive remedy. EXCEPT AS EXPRESSLY PROVIDED IN THIS DOCUMENT, THERE IS NO WARRANTY OR GUARANTY OR MERCHANTABILITY, OR FITNESS FOR A PARTICULAR PURPOSE, OR OF ANY OTHER KIND, EXPRESS OR IMPLIED, WITH RESPECT TO THE SERVICES PERFORMED OR PARTS FURNISHED BY US. IN NO EVENT SHALL MES INDUSTRIES INCORPORATED d/b/a P&W SERVICE CENTER BE LIABLE FOR DAMAGES IN EXCESS OF THE ORIGINAL PRICE PAID FOR THE REPAIR OF THE PAGER OR EQUIPMENT OR THE PURCHASE PRICE PAID FOR THE EQUIPMENT, FOR ANY LOSS OF USE, LOSS OF TIME, INCONVENIENCE, COMMERCIAL LOSS, LOST PROFITS OR SAVINGS OR OTHER INCIDENTAL, SPECIAL OR CONSEQUENTIAL DAMAGES ARISING OUT OF THE USE OR INABILITY TO USE SUCH PRODUCT, TO THE FULL EXTENT SUCH MAY BE DISCLAIMED BY LAW.

III. What the Standard Limited 90 Day Warranty Covers

In the event of a malfunction during warranty period, P & W Service Center, at its option, will either repair, or refund the original service price paid, for the repair of the pager or equipment under warranty. Repair, may include the replacement of the parts or boards with functionally equivalent reconditioned or new parts and boards. Replacement parts and boards are warranted for the balance of the original warranty period. All parts and boards removed in the replacement process shall become the property of P & W Service Center. This warranty does not cover defects, malfunctions, performance failures or damages to the unit resulting from use in other than normal and customary manner; misuse, accident, neglect, improper alterations or repairs. This warranty does not cover batteries, housings, holsters, repair of water and/or physical damage. Unauthorized disassembly or repairs, of the pager or equipment by anyone other than P & W Service Center will void this warranty. The misuse, or neglect of the pager or equipment resulting in water and/or physical damage will void this warranty. Failure to pay for the service to the pagers or equipment covered by this warranty within the specified time frame listed on the invoice will result in this warranty being voided. Buyer shall prepay shipping charges and insurance for Products returned to P&W Service Center for warranty service. P&W Service Center will pay costs for return of the Products to Buyer via ground service.

IV. Optional Extended Warranty

This optional extended warranty is provided in lieu of the Standard Limited 90 Day Warranty for a consideration over and above the price paid for the pager. This optional extended warranty covers parts and labor for the number of years chosen starting at the time of shipment listed on the Invoice. In addition to the coverage in Section III, pagers purchased with this optional extended warranty are covered during the entire extended warranty period for one replacement of broken (not missing) housings and clips with a functionally equivalent used housing of the same color at no charge. The intended purpose is to replace needed (not missing) housings on pagers that may become damaged during normal use during the extended warranty period. Subsequent replacement of housing parts will be subject to additional charges. Also Covered during the entire extended warranty period is repair of water and/or physical damage with one replacement of an electronic circuit board (if needed due to water or physical damage (not missing)) with a functionally equivalent used circuit board at no charge (does not cover damage due to unauthorized workmanship). The intended purpose is to replace needed (not missing) circuit boards in pagers that may become damaged during normal use during the extended warranty period. Subsequent replacement of circuit boards will be subject to additional charges. Buyer shall prepay shipping charges and insurance for Products returned to P&W Service Center for warranty service. P&W Service Center will pay costs for return of the Products to Buyer via ground service.

V. How to Receive Service

Send the pager or equipment to P&W Service Center along with a copy of the original Invoice and proof of payment. All original manufactures warranties supersede P&W Service Centers Warranty so products must be sent directly to the original manufacture for warranty repair.

VI. State Law Rights
